For purposes of this Waiver, “Evoq” includes all Evoq and Evoq Wellness branded experiences operated by Evoke Health and Wellness Group, LLC.

By registering for, attending, or participating in any Evoq class, event, workshop, or wellness experience (“Event”), you acknowledge and agree to the following:

Assumption of Risk

You understand that participation in physical activities such as Pilates and fitness instruction involves inherent risks, including but not limited to bodily injury, muscle strains, falls, illness, or other adverse conditions. You voluntarily assume all risks, known and unknown, associated with participation.

Release of Liability

To the fullest extent permitted by law, you release, waive, and discharge Evoke Health and Wellness Group, LLC, Evoq, and all affiliated instructors, employees, contractors, sponsors, partners, venues, landlords, and collaborators from any and all claims arising from participation in the Event.

Medical Acknowledgment

You affirm that you are physically able to participate and have consulted a healthcare professional if necessary. Evoq does not provide medical advice or diagnosis.

Indemnification

You agree to indemnify and hold harmless all released parties from any claims or damages resulting from your participation.

Governing Law

This Waiver shall be governed by the laws of the State of New Jersey.

Media Release

By attending any Evoq/Evoq Wellness Event, you grant Evoke Health and Wellness Group, LLC the irrevocable right to photograph, film, and record you for marketing, promotional, and commercial purposes. You waive any right to inspect or approve such media and release all claims related to its use.

If you do not wish to be recorded, it is your responsibility to notify Evoq staff in writing prior to the Event.

Sponsor, Venue & Collaboration Disclaimer

Evoq Events may be hosted in partnership with third-party sponsors, venues, hotels, and collaborators. Evoq does not control or assume responsibility for the acts, omissions, or services of third parties. Participation in any Event constitutes agreement that all such third parties are included as released parties under applicable waivers and releases.
